Dhaka, Nov 30 (V7N) – The Quick Enhancement of Electricity and Energy Supply (Special Provision) Act 2010 has officially been repealed through an ordinance promulgated by the president following the Advisory Council's approval.

The ordinance, titled 'Quick Enhancement of Electricity and Energy (Special Provisions) (Repeal) Ordinance, 2024,' received the council’s endorsement on November 20 and was subsequently approved for promulgation on Thursday.

Despite the repeal, all contracts and measures undertaken under the act before its termination will remain valid. Ongoing activities under such agreements must continue or conclude as if the law were still in effect.

Furthermore, the government retains the authority to review activities carried out under the repealed law in the public interest and may take necessary actions as deemed appropriate.

The repeal follows a High Court (HC) verdict on November 14, declaring the immunity provision in Section 9 of the act “illegal and unconstitutional.” This section previously prohibited any court from questioning the validity of actions taken under the law.

Additionally, Section 6(2) of the act mandated that any planning or investment proposals required the energy minister’s approval and subsequent clearance by the cabinet committee after negotiations with relevant institutions in accordance with Section 7 of the act.
