Dhaka, Feb 26 (V7N) – The Appellate Division has granted leave to appeal to Jamaat-e-Islami leader ATM Azharul Islam, who was sentenced to death for crimes against humanity during the 1971 Liberation War. The court has also set April 22 for the next appeal hearing.
A five-member appellate bench, led by Chief Justice, issued the order on Wednesday (February 26).
Legal Proceedings and Background
The decision comes a day after the first review petition hearing on Tuesday (February 25). Previously, on February 23, the court scheduled the review hearing date.
On October 23, 2019, the Appellate Division upheld the death sentence of ATM Azharul Islam, a ruling issued by a bench led by then Chief Justice Syed Mahmud Hossain. However, Azhar later filed a review petition against this ruling.
Earlier, on December 30, 2014, the International Crimes Tribunal sentenced Azhar to death by hanging for crimes against humanity committed during the Liberation War.
Charges Against ATM Azharul Islam
ATM Azharul Islam was convicted of six counts of crimes against humanity, including:
- Genocide and murder of 1,256 people in Rangpur,
- Kidnapping of 17 individuals,
- Rape,
- Unlawful detention and torture of 13 people,
- Looting and arson of hundreds of homes.
The tribunal sentenced him to death on five charges, excluding one. However, Jamaat-e-Islami has continued to reject the verdict, calling it politically motivated.
Defense Claims and Appeal
On January 28, 2015, Azhar’s defense team appealed for his acquittal on 113 grounds, asserting his innocence. They submitted a 2,340-page appeal, including a 90-page principal appeal, to the Appellate Division.
With the latest ruling, all eyes are now set on the April 22 hearing, which could be pivotal in determining the fate of ATM Azharul Islam.
