Dhaka, Mar 03 (V7N) — The High Court has issued a rule asking the authorities to explain why the July National Charter Implementation Order, the Referendum Ordinance, and the oath of the Constitutional Reform Council should not be declared illegal.
The rule was issued on Tuesday (March 3) by a High Court bench comprising Justice Razik Al Jalil and Justice Md. Anwarul Islam Shaheen following a hearing on a writ petition challenging the legality of the measures.
During the hearing, Barrister Ahsanul Karim and Barrister Mamun Mahbub appeared on behalf of the writ petitioners and argued in favor of issuing the rule. Advocate Shishir Monir represented the opposing side and argued against the writ petition.
In the petition, the writ petitioners sought the issuance of a rule to quash the July National Charter Implementation Order and the Referendum Ordinance, contending that the measures were not in accordance with constitutional provisions.
Following the hearing, senior lawyer Shishir Monir told reporters that the government is allegedly attempting to bypass Parliament by advancing reform proposals through executive measures and judicial processes. He claimed that political matters are being brought before the court despite the ruling party having the parliamentary strength to address such issues through legislative channels.
The court has asked the concerned authorities to respond to the rule within a stipulated time. Further proceedings in the matter are expected after the submission of replies.
