This initiative, aimed at incentivizing voter participation in key swing states, may potentially violate federal election laws prohibiting the provision of monetary incentives to influence voting behavior.

The warning originated from the department’s public integrity section, which is responsible for investigating election-related violations. Reports indicate that the department recently communicated its concerns in a letter to America PAC’s legal representatives.

Musk has openly supported Republican presidential candidate Donald Trump and recently initiated the lottery, claiming that eligible participants are not required to register as Republicans or pledge to vote in the upcoming election. However, the PAC's promotional materials indicate that participants must endorse the Second Amendment, which is often associated with Trump’s policy platform.

The program targets registered voters in states critical to the election, including Pennsylvania, Georgia, and Arizona, and provides links for voter registration. A coalition of former Republican lawmakers and Justice Department officials has called for an investigation into Musk’s actions, arguing that the lottery constitutes a violation of laws against paying individuals to sway electoral outcomes.

As of now, the Justice Department has refrained from commenting further on the situation. Musk has yet to address the potential legal implications of his initiative, which remains active until Election Day on November 5. Reports indicate that four voters have already received cash prizes, underscoring the controversial nature of this unprecedented electoral strategy.
