Dhaka, Dec 11 (V7N) — International criminal law expert Toby Cadman, special advisor to the Chief Prosecutor of the International Crimes Tribunal (ICT), has expressed optimism that India will cooperate if requested to return Sheikh Hasina to Bangladesh for a fair trial regarding the alleged July-August genocide.
Cadman made these remarks after meeting with the tribunal's Chief Prosecutor and officials from the investigation agency on Wednesday morning. He emphasized that the trial would adhere to international standards and transparency.
Cadman noted that if India, as a democratic country, does not comply with the formal request once charges are framed, the Bangladesh government might consider conducting the trial in her absence. He also indicated the possibility of seeking the cooperation of the International Criminal Court (ICC) if needed.
Addressing concerns from countries hesitant to extradite individuals facing the death penalty, Cadman remarked, "The reality in Bangladesh is different, and those countries need to understand this. The court will decide whether the death penalty will be imposed or not."
He commended the tribunal's reforms, stating that the amended ICT Act aligns with international legal standards. "Further amendments may be necessary, and we will propose these collectively," he added.
Cadman described the alleged July-August massacre as a pursuit of justice rather than vengeance. He expressed satisfaction with the tribunal’s handling of cases and reaffirmed his commitment to ensuring that the legal process remains fair and credible under international law.
Toby Cadman, co-head of the London-based Guernica 37 law firm, was appointed as a special advisor to Chief Prosecutor Mohammad Tajul Islam following the recent political transition in Bangladesh. Since arriving in the country, Cadman has been actively involved in consultations to support the tribunal’s work. On September 2, he held a meeting with Chief Advisor Dr. Muhammad Yunus at the latter's residence, Jamuna.
This development comes amid heightened efforts to address the alleged atrocities and ensure accountability through legal mechanisms.
