Dhaka, Nov 04 (V7N)- Advocate Zainul Abedin, counsel for BNP Secretary General Mirza Fakhrul Islam Alamgir, has appealed that the caretaker government system, if restored, should be implemented from the 14th parliamentary election.
He submitted the appeal on Tuesday (November 4).
Advocate Zainul Abedin claimed that the verdict abolishing the caretaker government system was fraudulent and insisted that it would be overturned in any domestic or international court.
The seventh day of appeal hearings began in the seven-member bench of the Appellate Division, headed by Chief Justice Dr. Syed Refaat Ahmed, on Tuesday morning.
Earlier, on the sixth day of the hearing, BNP lawyers argued that the abolition of the caretaker system had caused a deep political crisis in the country, making its reinstatement essential. During the earlier sessions, lawyers representing Jamaat-e-Islami and the civic platform Sujan also placed legal arguments in favor of restoring the caretaker system.
On August 27, the Supreme Court granted leave to appeal on petitions seeking a review of the 2011 judgment that abolished the caretaker government provision. Appeals were later filed by BNP Secretary General Mirza Fakhrul Islam Alamgir, Jamaat Secretary General Golam Parwar, Dr. Badiul Alam Majumder, and five others.
It may be recalled that in 2011, the Appellate Division, led by then Chief Justice ABM Khairul Haque, delivered the verdict that declared the caretaker government system unconstitutional, effectively ending the provision.
