Dhaka, Oct 02 (V7N): The High Court has retracted its August 4 decision that required Grameen Kalyan, an organization owned by Nobel laureate Dr. Muhammad Yunus, to pay Tk666 crore in taxes to the National Revenue Board (NBR).

The latest ruling was based on a judge's previous involvement in the case. The court also forwarded the case to the chief justice for further review on Thursday.

A bench comprising Justice Muhammad Khurshid Alam Sarkar and Justice SM Moniruzzaman passed the new order. Dr. Yunus's lawyer, Abdullah-Al-Mamun, explained that the senior judge cited the need to recall the ruling because the other judge had earlier served as the deputy attorney general, representing the government in this very case.

Abdullah-Al-Mamun added: "Since the judge had previously been involved in the case, issuing a ruling would be improper. Therefore, the ruling was withdrawn, and the matter is now with the chief justice for reassignment to another court."

When asked why this issue wasn't raised earlier, the lawyer expressed concern, saying, "This situation has caused embarrassment, as it might send a wrong message suggesting Dr. Yunus took this action due to his position as chief advisor."

Earlier, on August 4, the High Court had dismissed a writ that challenged the NBR's demand of Tk666 crore in taxes against Grameen Kalyan, ordering the organization to pay the amount.

Grameen Kalyan, chaired by Dr. Yunus, had filed separate writs in 2017 concerning tax demands for the fiscal years 2012-13 through 2016-17. After hearing the rule, the High Court delivered its ruling, which was subsequently contested by the NBR through a leave to appeal.
